- Since 1 January 2025 your landlord must give you a points calculation with every new contract.
Is your rent too high? In the Netherlands, a self-contained home with 186 points or fewer cannot ask more than €1,228.07 a month in kale huur (basic rent) on a contract starting in 2026, according to Volkshuisvesting Nederland. On 19 October Tilburg students raised the same problem for rooms: an Argos study cited by Omroep Brabant found 68% of the rooms checked above their legal maximum.

RentHunter listing data from free-sector platforms and agencies, studios and apartments of 40 m² or less first seen from 1 January to 21 October 2026. Housing corporations, municipal portals, student housing providers, anti-squat and serviced apartments are left out, a home listed on several platforms counts once, and nothing is reported on fewer than 100 homes.
Listed above does not mean overcharged. An asking rent can include service costs or furniture, and the number of points depends on more than size (energy label, kitchen, bathroom, the WOZ property valuation). A property with 187 points is free sector, with no cap. Still, a 30 m² studio at €1,400 deserves a check.
How to check if your rent is too high in the Netherlands
- Ask for the points calculation (puntentelling) before you sign. Your landlord owes it to you, even for a free sector flat.
- Run the Huurcommissie rent check with the energy label and WOZ value at hand.
- Compare the basic rent, not the total you pay: ask for the split between kale huur, service costs and furniture.
- Act within 6 months. The Huurcommissie (rent tribunal) assesses a starting rent if you apply within 6 months of the contract start, and a lower rent applies from day one.
- Keep paying the agreed rent until the ruling. A landlord who skips the rules can be reported to your gemeente (municipality) under the Wet goed verhuurderschap.
the Wet toekomstbestendige huurcommissie (Staatsblad 2026, 311) will make a written notice to the landlord mandatory for defects, from a date still to be set by royal decree. Use email now anyway.
